These Terms of Service ("Terms") govern your use of BaringaSoft Pulse ("the Software"), a desktop caseload management application published by BaringaSoft LLC ("we," "us," or "BaringaSoft"). By downloading, installing, or using BaringaSoft Pulse, you agree to these Terms. If you don't agree, don't use the Software.

1. License Grant

When you purchase BaringaSoft Pulse, we grant you a perpetual, non-exclusive, non-transferable license to use the Software on one machine at a time. You may deactivate your license on one machine and activate it on another — your license key follows you, not your hardware.

This license is for personal or professional use by the individual who purchased it. It does not permit use by multiple people sharing a single license. If your organization needs multiple seats, contact us at baringasoft@tuta.com.

2. Free Trial

BaringaSoft Pulse is available as a 30-day free trial with full access to all features — no credit card required. After 30 days, the Software enters read-only mode: you can view all your existing data but cannot add or edit records until you activate a license.

Your data is never deleted or locked away when the trial expires. If you purchase a license later, full access is restored immediately upon activation.

Your data is yours. We have no access to it. BaringaSoft Pulse stores everything locally on your machine in an encrypted database (SQLCipher / AES-256). No client data is ever transmitted to BaringaSoft or any third party.

The only network activity the Software performs is:

Because your data never leaves your machine, you are the data controller for any personal or sensitive information you store — including information about your clients. You are solely responsible for ensuring your use of the Software complies with any applicable laws or regulations, including but not limited to HIPAA, state privacy laws, and your organization's data policies. BaringaSoft makes no warranties about regulatory compliance and cannot be held responsible for your organization's compliance obligations.

You are also responsible for maintaining your own backups. The Software provides built-in backup tools to make this easy, but BaringaSoft does not store or hold copies of your data and cannot recover it for you.

5. Password & Data Recovery

BaringaSoft Pulse requires a password to access your encrypted database. At setup, a recovery key is generated — save it somewhere safe. If you lose both your password and your recovery key, your data is unrecoverable. The encryption is designed so that BaringaSoft cannot decrypt or recover your database under any circumstances.

6. Deadline Alerts & Notifications

BaringaSoft Pulse includes color-coded deadline alerts designed to help you stay ahead of upcoming dates and obligations. These alerts are generated based on the data you enter and the rules you configure — they are a convenience tool, not a guarantee.

Deadline alerts are provided on a best-effort basis and should not be treated as a substitute for your own professional judgment, calendar systems, or organizational procedures. BaringaSoft does not warrant that alerts will always fire on time, display correctly, or account for every scenario relevant to your caseload. Software can have bugs, configurations can be incomplete, and edge cases can arise that no alert system will catch.

You — not the Software — bear ultimate responsibility for meeting deadlines, maintaining compliance, and fulfilling your professional obligations to the people you serve. We built Pulse to make that easier, but the duty of care remains yours.

7. Updates

Free updates are included for one year from the date of purchase. After that, you may continue using the version you have indefinitely — we just can't guarantee updates to future versions at no additional cost.

Updates are never applied automatically without your consent. You choose when (or whether) to update.

8. Payment & Refunds

BaringaSoft Pulse is sold as a one-time purchase — no subscription, no recurring charges. Payment is processed by LemonSqueezy, our payment provider.

9. Third-Party Services

Payment processing is handled by LemonSqueezy, who serves as the Merchant of Record for all transactions. LemonSqueezy's own terms of service govern the payment relationship. We are not responsible for LemonSqueezy's policies or practices.

Beyond license activation, the Software makes no calls to third-party services.

10. Disclaimer of Warranties

BaringaSoft Pulse is provided "as is," without warranty of any kind. To the fullest extent permitted by applicable law, BaringaSoft disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Software will be error-free, uninterrupted, or suitable for your specific needs. You assume all risk associated with the use of the Software.

11. Limitation of Liability

To the maximum extent permitted by law, BaringaSoft's total liability to you for any claim arising out of or related to the Software shall not exceed the amount you paid for your license.

BaringaSoft is not liable for any indirect, incidental, consequential, or special damages, including but not limited to: data loss, missed client deadlines, errors in reports, decisions made based on the Software's output, or loss of business.

This limitation applies regardless of the legal theory under which the claim is made.

12. Termination

You may stop using the Software at any time. Your data remains on your machine and accessible in read-only mode.

BaringaSoft may revoke your license if you materially violate these Terms (e.g., distributing the Software or bypassing license checks). We will attempt to notify you before taking such action.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in New York State.

You must be at least 18 years old to purchase or use BaringaSoft Pulse.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. For significant changes, we'll make a reasonable effort to notify active users. Continued use of the Software after changes are posted constitutes your acceptance of the updated Terms.
